Terms and Conditions – Coworking
1. General
1.1 By accepting membership with BASE Music or using any services provided at 102/25 Falcon Street, Crows Nest, NSW 2065, members agree to these terms and conditions.
1.2 These terms and conditions, along with any premises and services offered at the BASE Music, may be updated by BASE Music at its discretion. Changes take effect immediately unless stated otherwise.
1.3 Any disputes or claims arising out of or in connection with this shall be subject to the exclusive jurisdiction of the courts of New South Wales.
2. Fees
2.1 Membership fees are payable weekly in advance to the following bank account:

2.2 Membership and service fees are set at BASE Music's discretion, with at least 21 days' notice of any changes.
2.3 Late payments are subject to a $30 admin fee and may result in forfeiture of the Member’s desk and membership privileges.
2.3 A grace period of 5 days from the due date will be allowed before the late payment fee is applied.
2.4 If payment is not received by the end of the 5-day grace period, membership will be forfeited. Forfeiture means that any desks or other spaces occupied by the member will be made available to other clients or prospective clients, and the member will lose their right to use the desk.
2.5 If a member wishes to reinstate their membership after forfeiture, they must pay all outstanding fees, including any late payment fees, and reapply for a space. Reinstatement is subject to availability.
3. Services
3.1 Members will have access to the Site’s amenities and common areas and may be allocated a personal desk space if covered in their plan.
3.2 Business-grade WIFI internet is provided on a fair-use basis. BASE Music may refuse connection for excessive or illegal use.
3.3 Charges for additional services like studio hire, printing, phone use, mail handling, event coordination, and reception services will be invoiced separately and billed in arrears.
4. Insurance
4.1 Members are responsible for the security of their property at BASE Music and should insure any property brought to the site, as well as their liability to employees and third parties.
4.2 BASE Music recommends obtaining insurance to cover personal property, liability to employees, guests, and any other prudent risks.
4.3 BASE Music does not accept liability for any loss incurred by members or any
guests.
5. Liability and Indemnification
5.1 BASE Music is not liable for theft, loss, or damage at the site, nor for data or information loss or damage from communications failures, hardware or software issues.
5.2 Members agree to indemnify and hold harmless BASE Music, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with BASE Music’s performance of obligations under these terms and conditions or any breach of its terms.
5.3 Members are solely responsible for any claims, damages, or losses incurred by third parties resulting from their acts or omissions, negligence, or misconduct.
5.4 Members shall reimburse BASE Music for any costs or damages incurred as a result of any claims or actions arising out of BASE Music’s performance of its obligations under these terms and conditions.
6. Access and Security
6.1 Regular business hours at the Site are 9:00 AM to 7:00 PM, Monday to Friday, except for New South Wales Public Holidays.
6.2 Out-of-hours access is available on request for additional fees, subject to availability.
6.3 Members will typically be let into the site by BASE Music staff or another member during regular business hours.
6.4 If no one is available to let a member into the site or out-of-hours access is required, members will be instructed to obtain keys from the key safe at the entrance.
6.5 Despite being changed regularly, the code to the key safe must not be given to anyone without the prior consent of BASE Music.
6.6 Keys must be returned to the key safe immediately after entering the site.
6.7 In the event that a member loses any keys, they shall promptly notify BASE Music. Members will be responsible for the cost of replacing the keys and any associated security measures, including, but not limited to, changing locks. BASE Music reserves the right to charge members for the replacement and any additional security measures required.
6.8 Use of the site car park is prohibited unless a member is unloading heavy equipment for a maximum of 10 minutes. Members must not leave their vehicle in any of the parking bays for any amount of time and not obstruct access to parking bays, doorways or stairwells for clients and employees of other building tenants.
6.9 All members have a right to enjoy a reasonable level of quiet at the site during its regular business hours, when it functions primarily as a coworking office and waiting area for clients with studio and meeting room bookings. However, there may be an increase in activity outside of business hours, during which general noise levels may be higher, and desk spaces may need to be temporarily relocated for events such as workshops, rehearsals, performances and art shows. BASE Music will provide members with adequate notice of any potential inconveniences and make a substantial effort to ensure that members can still enjoy their time at BASE Music during these periods.
7. Parting with Possession
7.1 Members must not assign, sublet, or part with possession of the site before membership ends.
8. Guests
8.1 Members must notify BASE Music staff in advance if a guest needs access to the site in their absence. Otherwise, members are expected to physically let guests into the site.
8.2 Members are responsible for the conduct of their guests and must ensure they adhere to BASE Music’s policies and rules.
8.3 Any damages caused by guests will be the responsibility of their hosting member.
9. Use and Care of the Site
9.1 Members must keep the site clean and tidy at all times.
9.2 Members must not cause nuisance or harassment to other members and guests or interfere with their use of the site.
9.3 Members must not sleep at the site overnight.
9.4 Members must not smoke at the site.
9.5 Members must not use the site for immoral or illegal purposes.
10. Meeting Room, Studios & Event Space Bookings
10.1 Meeting Room, Studio and Event bookings will be invoiced separately from regular coworking membership.
10.2 Additional terms and conditions may apply to these bookings.
10.3 Booking cancellations or reductions must be notified in writing.
10.4 Cancellations or reductions made less than 24 hours before the booking start time will incur a 100% charge.
10.5 Damage to fixtures, fittings, and equipment by members or attendees and guests will be repaired or replaced at The Member’s expense.
10.6 No illegal activities are allowed in meeting rooms, studios or event spaces.
11. Photography and Social Media
11.1 Members consent to being photographed by or on behalf of BASE Music
11.2 while at any site, unless they notify BASE Music otherwise. Photos may be used for advertising, newsletters, marketing, and web content without royalty, fee, or compensation to members.
11.3 Members are encouraged to invite @basemusicstudios as a collaborator on any Instagram posts and reels that feature the site.
11.4 Members are encouraged to mention @basemusicstudios in any Instagram stories that feature the site.
